Service

By accessing or using the Blue Butterfly software, website, platform, APIs, templates, or related services (collectively, the “Service”), you (“User,” “you,” or “your”) agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service.

Who We Are

Blue Butterfly is a software service currently operated by its owner. Upon formation of a legal entity, including but not limited to Blue Butterfly LLC, these Terms will automatically apply to that entity, and all rights, obligations, and agreements may be assigned to such entity.

Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction to use the Service. By using the Service, you represent that you meet this requirement.

Acceptance of Risk

The Service is provided on a beta and experimental basis. You acknowledge that:
  • Features may be incomplete, unstable, or contain bugs
  • Data loss, errors, or downtime may occur
  • You use the Service at your own risk

Account Responsibility

You are solely responsible for:
  • Maintaining account confidentiality
  • All activity under your account
  • Providing accurate information
  • Ensuring your data and content are lawful

You must immediately notify us of unauthorized use.

User Content and Templates

  • You retain ownership of all content you upload, including templates, projects, and data
  • By uploading content, you grant Blue Butterfly a worldwide, royalty-free license to store, process, backup, and display it as necessary to operate the Service
  • You are solely responsible for the content you share; Blue Butterfly is not liable for it

Acceptable Use

You may not use the Service to:
  • Violate any laws or regulations
  • Upload malicious or harmful code
  • Interfere with others’ use of the Service
  • Attempt to reverse engineer or bypass security measures
  • Sell or resell the Service without permission

Violation may result in account suspension or termination.

Billing and Fees

  • The Service is currently free
  • Blue Butterfly may introduce fees in the future
  • Users will be responsible for all applicable fees and taxes
  • Fees may vary by usage, number of users, storage, or services
  • All fees are non-refundable unless required by law

Data Retention

  • Blue Butterfly retains user data as necessary to operate the Service, comply with legal obligations, and enforce these Terms
  • Data may be retained after account termination, including backups and archives
  • No automatic deletion is guaranteed unless required by law
  • Users are responsible for maintaining their own backups

Third-Party Services

The Service uses third-party providers, including but not limited to Supabase, for hosting, authentication, analytics, and infrastructure.
  • We do not control these providers
  • We are not liable for outages, data loss, or breaches originating from them
  • By using the Service, you consent to your data being processed by third-party providers

Disclaimers

  • The Service is provided “as-is” and “as available”
  • Blue Butterfly makes no warranties regarding uptime, accuracy, security, or suitability for your purposes
  • We are not responsible for data loss, project errors, or any business interruption

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:
  • Blue Butterfly, its affiliates, and providers are not liable for direct, indirect, incidental, special, consequential, or punitive damages
  • This includes lost profits, lost data, or loss of goodwill
  • Our total liability is capped at $100 USD or the total fees paid in the last 12 months, whichever is higher

Indemnification

You agree to defend, indemnify, and hold harmless Blue Butterfly and its officers, employees, contractors, and affiliates from all claims, damages, liabilities, and expenses arising from:
  • Your use of the Service
  • Your content
  • Violation of these Terms or applicable laws
  • Interactions with other users

Termination

  • We may suspend or terminate your account for violations of these Terms, abuse, non-payment (if applicable), or at our discretion
  • Upon termination, your license ends immediately, and we may delete your data without notice
  • Users may terminate their accounts at any time

Governing Law & Dispute Resolution

  • These Terms are governed by the laws of the State of Texas
  • Any disputes will be resolved by binding arbitration in Travis County, Texas
  • You waive rights to class actions or jury trials

Changes to Terms

Blue Butterfly may update these Terms at any time. Continued use of the Service constitutes acceptance of the updated Terms.
